Grandma For the Win!

A grandmother gathered her two grandchildren and whisked away, into the car to visit her son, the grandchildren’s uncle, who lived in a special-needs home. She was looking forward to seeing her son, being able to give him a hug and tell him how much she missed him. However, instead of a heartwarming reunion among family, she was t-boned by a reckless driver as she pulled out of a gas station. Her life would never be the same.
While luckily the two children were unharmed, the grandmother, whom later became our client, sustained severe injuries. She required cervical fusion surgery, an operation where bones in the neck or spine need to be reconnected by moving other bones within the system, and in some cases bone grafting. Even after the recovery time from the surgery had elapsed she experienced ongoing neck pain.
Our client, a caring nurturer, loving mother and grandmother, suffered terrible injuries. She had to worry about how her family would operate in her absence, recover from surgery, worry about medical bills, and figure out how to financially make ends meet. While the defendant tried to place blame on our client, claiming she had switched lanes into the defendant’s car, our team presented photo evidence that proved our client was not at-fault for the accident. The accusations from the defendant didn’t stop there. They attempted to suggest that our client’s neck injuries were a result of degenerative issues and existed before the accident, even though our client didn’t have any prior neck issues. With the help of medical records obtained by our firm we were also able to dispel that argument.
Although the defendant tried to push back on our client receiving what was entitled to them, Dworkin & Maciariello pushed back harder. In the end she received $337,500.
We wish no one had to suffer through pain and distress due to another’s negligence like our client did, but this world is not perfect. Being able to abate the grief of a deserving woman and help her start down the path back to recovery and her family was a rewarding experience.
